Data Processing Terms
Controller and processor roles, customer obligations, international transfers, and how to obtain a signed agreement.
Roles
For contact data we supply, CallCenterBoost acts as an independent controller in respect of sourcing, validating and supplying the data. The customer becomes an independent controller of that data on delivery and determines the purpose and means of any campaign carried out with it. We are not the customer's processor for those campaigns.
For hosted services — VICIdial servers and cloud desktops — the customer is the controller of any personal data it loads into that environment and CallCenterBoost acts as a processor in respect of the hosting.
Customer obligations as controller
- Determine and document a lawful basis for contacting each individual.
- Provide the privacy notice required in the customer's jurisdiction, including the source of the data.
- Register with and screen against the applicable do-not-call or preference register in each destination.
- Observe permitted calling hours, caller-identification and consent rules in each destination.
- Honour opt-out, unsubscribe and erasure requests received directly, and pass on any request that concerns our source data.
- Keep supplied data confidential and not resell or re-license it without written permission.
International transfers
Where personal data is transferred across borders, an appropriate transfer mechanism is applied — standard contractual clauses, an adequacy decision, or another lawful mechanism available in the exporting jurisdiction. Details of the mechanism relied on for a given service are available on request.
Assistance and audit
- We assist customers with data subject requests that relate to data we supplied.
- We notify customers without undue delay of a security incident affecting their data.
- Customers under contract may request our security documentation once per year; on-site audit may be substituted with a written questionnaire.
Signed agreement
A signed data processing agreement is available to any customer under contract on request from support@callcenterboost.com. Where the customer requires its own paper, we will review it.
