Call Center Compliance Basics: Consent, DNC, Caller ID and Data
This page is an orientation, not legal advice. Rules depend on where your call center is, where the people you call are, what you are selling or supporting, and what your contracts say. Confirm the rules for each campaign and destination with a qualified adviser before calling.
Which laws apply?
Usually more than one set. The rules of the country where the called person is located normally apply to the call, in addition to the rules where your business operates and any obligations in your client contract. Industry-specific rules (financial services, insurance, healthcare, debt collection) add further requirements.
Lawful basis to contact
- Know, for every list, where the data came from and on what basis each person may be contacted (for example consent, an existing customer relationship, or another basis recognised by the applicable law).
- Keep evidence of consent where consent is required: when, how and for what it was given.
- Do not use purchased, scraped or "leaked" lists whose origin you cannot verify.
- Automated or pre-recorded calls (including many Press 1 campaigns) are often subject to stricter consent rules than live calls.
Opt-outs and do-not-call
- Screen lists against national do-not-call registers where they exist and are applicable.
- Maintain your own internal suppression list and honour opt-out requests immediately and permanently for that client.
- Apply suppression before import into the dialer, not afterwards.
- Record opt-outs with date and time.
Caller ID and calling hours
- Present a valid caller ID you are authorised to use; do not spoof or hide it where the law requires presentation.
- Respect permitted calling hours in the called person's local time zone — configure them per campaign in the dialer.
- Identify yourself and the business you are calling for at the start of the call.
- Keep within abandoned-call limits for predictive dialing, and play any required message on abandoned calls.
Call recording
- Tell callers when calls are recorded where the law requires it, and obtain consent where required.
- Restrict who can access recordings, and log access.
- Set a retention period and delete recordings when it expires.
- Never record payment card numbers in plain audio; use pause-and-resume or secure payment methods.
Data protection and security
- Collect and keep only the data a campaign needs.
- Sign a data-processing agreement with clients where you process personal data on their behalf.
- Control access with individual logins, least privilege and audit logs.
- Encrypt devices and backups; avoid personal email and USB drives for client data.
- Have a breach-response procedure with notification deadlines that apply to you.
Examples of rules to look up
CallCenterBoost does not provide legal advice and makes no compliance guarantee. Customers are responsible for the lawfulness of their own traffic in every destination — see the Acceptable Use Policy.
The following are examples of frameworks you may need to check, depending on where you and the people you call are located. They are not a complete list and the details change over time:
- United States: the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule and the National Do Not Call Registry, plus state rules.
- United Kingdom: the Privacy and Electronic Communications Regulations (PECR), the UK GDPR and the Telephone Preference Service (TPS).
- European Union: the GDPR plus national telemarketing and ePrivacy rules in each member state.
- India: the TRAI telecom commercial communications regulations (including registration and preference requirements) and data-protection law.
- Philippines: the Data Privacy Act and rules from the National Privacy Commission.
- Employment, health-and-safety and night-work rules where your agents work.
Frequently asked questions
Do I need consent to make sales calls?
It depends on the country, the type of call (live vs. automated), whether the person is a business or consumer and whether there is an existing relationship. Check the rules for each destination before calling.
Do I have to tell people calls are recorded?
In many places, yes — and in some, every party must consent. Configure a recording notice in your IVR or script unless you have confirmed it is not required.
